NDIS claims within 90 days and new record keeping rules
By the Supportd team · Checked against official sources on 14 October 2026
The short answer
Since 27 August 2026 participants and plan managers must keep records of NDIS payments for 3 years, and providers for 7 years. From 1 December 2026 claims must be made within 90 days of the support being delivered.
Keeping records (from 27 August 2026)
- Participants and plan managers: keep records of NDIS support payments for 3 years
- Providers: keep records about payment and receipt of NDIS funds for 7 years
- If a record is not in the required format, you can provide other evidence that the service was received
- Intentionally destroying records to defraud the NDIS or disrupt an audit or investigation is now an offence, with up to 2 years in prison
Claiming within 90 days (from 1 December 2026)
Participants or their plan managers will need to make claims within 90 days of the support being delivered. If you are self managed, that means paying and claiming promptly rather than batching invoices for months. If you are plan managed, your plan manager needs your provider invoices quickly.
Fairer debt recovery (from 27 February 2027)
- The NDIA must tell you a debt exists and why
- Participants have 28 days to respond and providers 14 days
- The NDIA must explain whether and why it will recover the debt
- Debts under $500 that are not cost effective to recover can be waived (up from $200)
Easier claiming later
By 30 June 2028 an improved NDIS app is due to let self managed participants use tap and go claiming. Claims above a certain amount will need supporting documents.
What to do now
- Self managed: set a weekly or fortnightly routine to pay and claim invoices so nothing passes 90 days.
- Keep invoices, receipts and service agreements in one folder, digital is fine, for at least 3 years.
- Ask your providers to invoice promptly after each service or at least monthly.
- Providers: check your invoicing cycle and your record retention, which is now 7 years.
